Terms of Service

By accessing or using Battle Athletic (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. These Terms apply to all users of the Platform, including coaches, athletes, parents or guardians, and administrators. If you are accessing the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Battle Athletic is a sports performance platform that enables coaches to build training programs, manage athlete rosters, log workouts, and track athletic performance. Athletes can access their assigned programs, log sets and reps, view progress history, and build a recruiting profile. The Platform includes a web application for coaches and administrators, a mobile application for iOS, and an iPad-optimized weight room interface for in-gym logging. We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.

To use Battle Athletic, you must create an account. You agree to: • Provide accurate, current, and complete information during registration • Maintain the security of your password and accept responsibility for all activity under your account • Notify us immediately of any unauthorized access or breach of security • Not share your account credentials with others or create accounts on behalf of others without their consent You must be at least 13 years old to create an account. Users under 18 must have a parent or guardian's consent. Coaches creating accounts for minor athletes are responsible for obtaining appropriate consent.

Coaches who use Battle Athletic are responsible for: • Ensuring that all programs and instructions provided to athletes are safe and appropriate for each athlete's age, fitness level, and health status • Obtaining any necessary consent from athletes or their guardians before adding them to the Platform • Maintaining appropriate professional boundaries and conduct with athletes • Complying with all applicable laws, regulations, and institutional policies Athletes and their guardians are responsible for: • Providing accurate health and medical information where requested • Communicating any limitations, injuries, or concerns to their coach • Using the Platform in accordance with their coach's guidance

You agree not to use the Platform to: • Violate any applicable law, regulation, or third-party rights • Upload, transmit, or share content that is harmful, abusive, harassing, defamatory, or otherwise objectionable • Attempt to gain unauthorized access to any part of the Platform or other users' accounts • Use automated tools or bots to scrape, crawl, or extract data from the Platform • Reverse engineer, decompile, or disassemble any part of the Platform • Use the Platform for any commercial purpose without our prior written consent • Impersonate any person or entity, or misrepresent your affiliation with any person or entity We reserve the right to suspend or terminate accounts that violate these terms.

All content, features, and functionality of the Platform — including but not limited to software, design, graphics, text, and trademarks — are owned by Battle Athletic and protected by applicable intellectual property laws. You retain ownership of any content you submit to the Platform, including workout data, athlete profiles, and program content. By submitting content, you grant Battle Athletic a non-exclusive, worldwide, royalty-free license to use, store, and display that content for the purpose of operating and improving the Platform. You may not reproduce, distribute, modify, or create derivative works of Platform content without our explicit written permission.

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our collection and use of data as described in that policy. We take data security seriously, particularly for platforms that serve minors. We implement appropriate technical measures to protect your information against unauthorized access and disclosure.

Battle Athletic is currently free to use during our early access period. Paid plans may be introduced in the future. Before any paid features or subscription tiers are activated: • You will be given clear advance notice of any upcoming charges • You will have the opportunity to review and accept updated pricing terms before being billed • No charges will be applied to your account without your explicit consent We will provide reasonable notice (at minimum 14 days) before transitioning any currently free features to a paid tier.

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. Battle Athletic is not a medical or health service provider. Content on the Platform should not be construed as medical advice. Coaches and athletes are responsible for assessing the safety and appropriateness of any training program. To the fullest extent permitted by law, Battle Athletic shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform. Our total liability to you for any claim shall not exceed the greater of $100 or the amount you paid us in the past 12 months.

You may terminate your account at any time by using the account settings in the app or by contacting us. Upon termination, your right to use the Platform will immediately cease. We may suspend or terminate your account if we determine, in our sole discretion, that you have violated these Terms or engaged in conduct harmful to other users or the Platform. We will make reasonable efforts to notify you before termination unless the violation is severe or ongoing. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will survive termination.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be resolved in the courts of competent jurisdiction. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or Platform features. We will notify you of material changes by: • Updating the "Last Updated" date at the top of this page • Sending a notification through the Platform or via email Continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should discontinue use of the Platform.
